Peerless Websites – Terms and Conditions

(Please ensure that you read fully and understand the following terms before paying your initial fee.)

The Service: You or the Client's approval for work to commence shall be deemed a contractual agreement between you or the client and Peerless Websites. Once an initial payment has been received as outlined below in ' Payment ' and you or the client gives the go-ahead, this will indicate that you or the client accepts the terms and conditions on this page.

Peerless Websites will use reasonable endeavours to ensure an efficient service throughout the contract, but will not be responsible for loss of data, service interruptions, non-deliveries that are beyond the direct control of Peerless Websites, or by errors or omissions by you or the client.

We design websites only in compliance with you or the client's specifications. It is the you or the client's responsibility to ensure that the website and it's contents comply with current online trading laws and regulations.

Peerless Websites will not be held responsible for economic or consequential loss whatsoever.

Improper Use and Liabilities: The customer shall acknowledge that they will only use the service for lawful purposes only. Peerless Websitesis not responsible for any illegal actions by others such as viruses, Trojans, spyware or malicious website hacks.

The customer should take precautionary measures in keeping all log-in details secure and not let any third parties have access to this information. Should any suspicion arise with any account, Peerless Websites should be contacted immediately. Peerless Websites should be notified of any log-in detail changes.

Content submission: It is you or the client's responsibility to ensure that any required content is delivered on time to prevent delay and website completion. We ask all clients to provide information in advance as with an initial payment. On occasion where we are delayed by not receiving required information, we reserve the right to impose a surcharge on top of the total cost of work equivalent to the delay incurred.

Visualisations: Producing a visualisation, whether it be graphic design or web related design is a time consuming process. Because of this Peerless Websites can only offer one visualisation per contract. It is therefore important that you or the client submits any similar website addresses that inspire you and relevant colour schemes so we can get it right the first time.

Payment: Peerless Websites require an initial 50% payment of original quote before the service can be carried out. This commits us to you and vice versa. Once you or the client is satisfied with work carried out, Peerless Websites will then issue a final invoice for payment, on receipt of this payment the website will go live. Should a website be live before the remaining balance is paid, you or the client has 30 days from invoice date to pay any outstanding fees.

Peerless Websites may elect to suspend or terminate any service immediately upon any default payment by the customer.

Quotations: All work carried out is based on the original quote(s), should you or the client require further work once the initial quota has been completed a further charge will occur.

Domain & Host Registration: Any hosting packages bought through Peerless Websites shall meet the acceptable use policy of 'Heart Internet Ltd'. All Domain registrations shall meet the terms & conditions of 'Nominet UK'.

E-mail: Peerless Websites will setup any e-mails required with the mail-host. It is you or the client's responsibility to create the necessary POP3 E-mail account(s) on your default mail client. You will receive all the relevant information including any guides to help you.

Payment Methods: Payment can only be made via one of the following options:

  • Bank Transfer

  • Personal Cheque

  • Cash

Late Payments: Any account that has not been settled within 14 days of our final reminder will incur a late payment charge of 10% of which outstanding. Balance interest will be charged at 2% per month thereafter pursuant to the late payment legislation.

Copyright: It is you or the client's responsibility to ensure all items including text, images, animations, layouts, sounds and any other website content does not infringe on any copyright laws. Peerless Websites is not responsible for any copyright infringements where a client has issued material to us to be included in their website.

Intellectual Copyright: Peerless Websites holds intellectual copyright of any material, including source code and original images created for you or the client until payment of final invoice. On receipt of final payment we will transfer this intellectual copyright to the client.

SEO (Search Engine Optimisation): SEO is included on all packages. The order in which websites are ranked within search results is controlled by the search engines. Whilst we can optimise your website making it search engine friendly, it is impossible to make any guarantees on ranking position.

Consultancy Fees and Expenses: Consultancy fees are charged at our hourly rate, Peerless Websites charge a minimum of two hours. Traveling to and from you or the client will be charged at an hourly rate. All expenses when visiting a foreign premises are expected to be covered by the client.

Cancellation: Once initial payment has be received, payment is non refundable. All further work carried out will be invoiced accordingly.

Advertising: Peerless Websites reserve the right to place a small logo and link it to www.klicked.co.uk on the bottom of every web page.

Should Peerless Websites waive any of these terms on an individual basis, this shall not affect the validity of the remaining clauses or commit Peerless Websites to waive these on any other occasion.

By agreeing to these terms and conditions your statutory rights are not affected.

Peerless Websites reserves the right to modify any of these terms and conditions at any time.
